The medical practice doesn't carry workmans comp insurance. Can/is the employer responsible for paying medical bills associated with a clear on the job injury/ incident? An example would be: an employee who has just drawn blood on a patient who is known to have HIV, Hep C has accidentally stuck herself with the needle. The employee has seen a physician within the company, their blood was drawn at the time of the incident and was negative but 6 months later when the employee's blood was drawn it shows positive for Hep C. Is the employer responsible for medical care?

This will most likely be real pending a re-test of labs on the employee this happened to. In addition, yes I have had three threads regarding employment issues with this same employer and am doing my level best to get out of dodge but stay informed and ask questions to protect myself while I am still here as it has become clear the company has little interest in treating staff in a legal or fare way. I assumed (and maybe wrongfully) that this was the point of the "ask me help desk" to get answers to questions. If not perhaps you know of a better way to acquire the information I seek. I appreciate you taking the time to even read my questions. Thank You and have a wonderful day.

Yes, that's the purpose of the site but it is not unusual for one person to post all sorts of questions based on what if's which usually boil down to "this is homework."

I think your posts should be combined but, in the words of my colleague This8384, "I also thought I was going to marry one of the Hanson Brothers."

As a side issue - if State Law REQUIRES workers comp and the employer doesn't carry it, yes, I see the employer personally responsible for medical bils, pain and suffering, inability to earn an income.

And, yes, get out of Dodge. In fact I'd RUN out of Dodge at the first available moment.

Thanks JudyKay Tee for your reply, no Texas does not require that you carry Workmans Comp Insurance... guess I should have mentioned that earlier but regardless, should I use this site again... which I doubt as clearly I need to use other sources to obtain information as to not waste the time of such valuable people who can be answering questions of greater importance... since "this is homework". AND Hopefully very soon I will find employment where I won't need to ask such questions or use sites such as this to try an protect myself or the employees I have under me. I am certain others have been helped via your advice, I am just not one of them unfortunately... but I do sincerely appreciate people like yourself who are willing to participate on this site and offer advice good or bad. Perhaps the average person should be warned to not expect a helpful answer all time and seek other means to acquire the information they need. Lesson learned for me... thanks anyway and I hope eventually you fulfill your dream of marrying a Hanson Brother.

Thanks - I'm awaiting a call from the Hansons as I type this.

As always I am STARTLED by a State that does not require WC.

Shocking.

That would FORCE an injured person to go against his/her employer - wow.
