View Full Version : Default on bankruptcy & time LTDs

This is my second bankruptcy. I file for bankruptcy in Dec 2002 or Jan 2003 and made only a few 4 payments to trustee, trustee discharged his self in Dec 2006. Can I be discharged automatically due to the time limits? If so where and how can I do this or will I need a trustee. I have not made any payments on debts since Sept 2002

No, nothing is discharged. You have to contact Bankruptcy Court and ask for the status of your file.

Everything may be over Statute.

Are you saying you are now filing a second bankruptcy even though the first could be open?

This is my second bankruptcy, my status should be filed bankruptcy but is not discharged. I was asking if the courts could discharge me because its has be over the 6 year statue period. I do not believe the 2 year period applys to me. Do you have any idea where the bankruptcy court is in Toronto? Thank you very much for your reply.

I did not realize you are in Canada - I have no info on Canadian Bankruptcy Laws.
