I have been browsing through the forums and have seen some great advice, so I would like to post my situation in hopes of receiving some of that advice myself.

Rather typical situation as the other threads that have popped up on here.

I am on probation. 6 years.
I wrote 2 false perscriptions.

My probation has been rocky. Mostly due to health problems.

I had a baby, had a stroke, had an infection from a surgeory.. All of wich kept me bed bound for quite a while.

My original probations officer was actually a wonderful woman. She was there in the hospital with me a few times, and would come to my home for my visits while I was sick so that I would not have a missed appointment hitting my record.

One of the things her and I did was create a 'plan' for probation.
Basically, I had 300 hours of community service, a few drug classes and a 3 year NA/AA requirement.

We broke that down into steps so that I would be able to work on one thing at a time and complete everything successfully.

I have done just that and am now on my community service .
She left.

I have a new officer.

She doesn't understand why , 3 years into probation I have not done community service.

Understandable.. . but frustrating none the less.

Currently, I am paid up 2 months in advance on my fees. ( Simply because, you never know what could happen and I may , at some time, need that financial cushion)
I have completed ALL classes with letters of recommendation. And high praise from all of the councilors. I no longer do drugs. I even chair my own , personally created NA group.

I have started my own business .

I am now a mother.

I have missed 3 weeks in a row of community service due to absolutely no day care. I have always been up to date on everything but that.

I am in no way ' bucking the system' and my record shows this, but I still didn't complete my portion of the probation bargain.

She violated me a few weeks after getting her as a new officer because I had not gotten my community service done then. Yet again.. back to the original " plan" I had, that is what I thought would carry from officer to officer.
I was wrong and should have spoke up then.

I have never given a dirty UA.
Never missed an appt.
Paid up , and then some.

I even have enough money available to pay the rest of my fees off immediately.

Would it be reasonable to ask the judge at the hearing to be released from probation early? With money in hand?

Having "money in hand" certainly won't hurt. It's probably worth a shot. You've had legitimate medical issues and have been making a good faith effort to adhere to all the terms of your probation. As you know, "money talks."

I don't know if it was MY advice you saw, but here's my 2 cents.

They're not violating you for all the things you've been up to date on. They're violating you for the one thing you haven't been up to date on. So... get to getting it done!

Yes, your first PO was wonderful. This one isn't. So what? Do what's required of you, and they'll leave you alone.

Is it reasonable to ask the judge at the (violation) hearing to be released from probation early, NOT having completed your community service? No.

It WOULD be reasonable to ask him not to violate you because of ALL the things you HAVE been doing. Plus, it would be good to show the judge evidence that you have daycare arranged for.
