My mother let me move in with her after me and my girlfriend lost our apartment. My mom added me to her lease with her, so the landlord knows I am staying there. My girlfriend was staying with her father, but he wanted her to move out. I asked my mom to let her move in and she said yes, until we got on our feet. I have recently broken up with her, but she refuses to leave my mothers house. My mom went to care for my grandmother for the past 3months because her health is failing in another city, and I have been dealing with the landlord as far as paying the rent. How do I get her out of my moms house, without her being here, do I need to make my mom come back in order to get her out, what do I do?

Evict her according to the laws of your State - BUT only the owner of the property can evict her and it would appear that that's your mother.

You and your mom "rent" and you have basically subleased or sub rented to the girlfriend.

If you are listed as one of the renters, not merely a tenant, you can evict her, if you are just listed as a tenant your mother as the renter will have to evict.

She will have to be given formal notice, and if she does not move go to housing court for a formal eviction.

FrChuck is right - the fact that your mother is, in fact, renting and not the owner, slipped right past me. Sorry for the wrong info.
