View Full Version : They are taking home to pay old medical bills.

My disabled mom(Marilyn), my common law husband(Tracy) and myself(Nancy) move into his family home about 3 years ago to care for his father. His father was in a nursing home and wanted to live the remainder of his life back on his farm. His daughter had been caring for him a few years before he had to go to the care center. She received payments from a home health care program (Eldabridge). Anyway, we moved to the farm thinking this would be our home till the day we died. Little did we know Tracys dad had cancer and he passed away a few months after he was back home. Everyone in the family agreed that Tracy could have the farm. It needs a lot of work. But we love it anyway. But now the Dept of Human Services want to take it and sell it for about $60,000 for old medical bills and money that was paid to Tracys sister for the payments she had received. We are low income, so we have been in contact with fee legal aid. But all he keeps telling us is that he doesn't know what he can do to help us. We have been paying taxes for the last three years and Tracy has applied for disability because he can't use his hands for more then 10 minutes without having pain for hours after. We are in a panic. Please someone help us. Any sugestions welcome. Thanks

If the FREE lawyer can't help, I'd visit a paid one. You can't afford to let them take the house, even if you have to make payments to the lawyer.

Let me understand this a bit more: The home belonged to Tracy's father when he died? Have you probated the estate? Because if you had, and assuming there was no will, the home would probably go to Tracy, his sister, and any other siblings. It may well be that the Dept. of Human Services has no say in how this works out.

It may very well be... But without legal representation, the Dept of Human Services just might TAKE the property.

Court isn't about things working out the way they're supposed to. Court is about WINNING.
