View Full Version : Motion for Continuance after final schedule date

Right now I have a public defender but I am going to obtain private counsel. The only problem is that I won't have the money to obtain private counsel for another two weeks and the judge has set a final scheduling date for my case. My public defender wants me to take a plea but I don't want to take the plea and he has refuse to file any motions in my behalf. My last plea date is Monday and I want to know can I get a motion for Continuance to hire private counsel after a final scheduling date has been set by the judge

You can request a continuance, the judge does not have to honor it. Your reason could be to get new counsel perhaps

Hello D:

FIRE your lawyer. Do it by certified mail with a copy sent to the judge and the prosecutor. When you get to court WITHOUT any lawyer, tell the judge that you'll have one soon, and that you CAN'T proceed without one. They'll give you your continuance.
