Hello, I am spouse of green card holder. He has been in USA for 10 years. We got married 17.5.2009. I am F-1 student. Now I need to get my papers. So I asked you for your advise. Because I don't want to be no longer F-1 student. So is there some option to get V-visa nebo Adjustment status and start working? Thank you

How long has he been an LPR? Is there some reason he has not filed for citizenship?

Over 10 years. He just hasn't done that yet. There is no other reason. But If he fills out the petition for me now can I stay here legally without going to school and start working until he applies for his citizenship? Because that process takes some time and he is planing to go abroad for some time and finish this when he gets back.

Long wait for the spouse of a LPR, nothing to be done as he never filed for US citizenship. I advise him to file now, it is only taking about 4 months. When he is a USC, and you are married, you are an immediate relative, no PD wait. You can file the I-130 and the I-485 concurrently.

If he doesn't file for citizenship, you must maintain your F-1 for about 5 years, check the DOS visa bulletin for the PD for FB-2A.

Consult an immigration attorney, any one, basic case. Good luck.

Thank you for your answer. And do you know something about V visa? It is new nonimmigrant category and I think it is for spouses of green card holders.

not a new category, for applicants with I-130's filed before the LIFE Act date of 12/21/2000.
