Can I let my mom file for our house if I want it taken off my 2008 taxes?

No, the IRS matches social security numbers on Mortgage Interest Statements with the taxpayer number on the 1040 claiming the deduction. Plus the person paying the payment is the only one that can legally claim the deduction.

You can deduct mortgage interest only if
*you itemize your deductions
*You must be legally liable for the loan. You cannot deduct payments you make for someone else if you are not legally liable to make them.
*Both you and the lender must intend that the loan be repaid. In addition, there must be a true debtor-creditor relationship between you and the lender.
*The mortgage must be a secured debt on a qualified home.

What Mukata is saying is that the mortgage interest CAN be assigned to your mother if she is also legally responsible for the loan as a co-signer.
