View Full Version : Arrested before probation begins, now what?

Hello. Thanks in advance to any advice or answers you might be able to provide for me.

In January I plead guilty to DUI in Illinois. The sentencing was delayed until next week (may) in order for me to be able to drive during the interim period. The sentencing is to be one year unsupervised probation and revoked license for a year. A few weeks ago I was driving in MO and was arrested for felony possession of controlled substance (x2). I wasn't on probation yet.

I have some questions and concerns. When my probation in IL begins next week, will they be able to see that I was arrested in MO a few weeks ago? Will it matter, will they care? Lassuming my new dilemma goes badly and I have to take a plea (e.g, probation) and conviction, what will happen if I am already on probation? What kind of legal recourse do I have to minimize the damage caused here?

First yes they can find it, if and when the look.

The worst probation violation is not reporting the other problem.
So for something that may only get you a warning from a PO, you may end up with time in jail if you don't go and explain what happened.

You need to address this with the court.

Confused because this arrest has happened *prior* to going on probation... how is it a probation violation?

It isn't... But, you haven't been sentenced yet, and this will probably effect it.
