A friend of mine got into a fender bender the other day in a parking lot at an apartment complex. They said it happened so fast they're not sure if their car was in reverse or if the other car hit them. They drive a big truck and the other car is a little bmw. His hitch went into her front bumper closer to the driver side because she was turning the corner when it happened. The police said they couldn't write a report. They went to exchange info and he couldn't find all of his so he gave her some false information, but called his insurance company when he got home to make a report. When she later called back furious he told her what happened, gave her correct information and told her he already contacted his insurance company. They have the same insurance and being as it's on private property should he worry about her trying to sue him or will this just be up to her to fix her car since they have the same insurance?

No way to know what will happen - if his insurance doesn't pay, yes, he'll probably end up in Court. If she claims pain and suffering, yes, he'll probably end up in Court. If she decides to report his false info to the Police and/or the insurance company (because they have the same company) he will find himself in more serious trouble.

The fact that the accident happened on private property matters little. I investigate accidents on private property all the time and the Police (in NY) DO write reports. If the damage is not serious, then they just give both parties information about the other party. Obviously if your friend lied to the Police, he has other problems.

I continue to be amazed by the number of people who post on behalf of their friends.
