I'm not the best at this question or forum, but the best advice that I can give is to scroll to the very bottom of the screen and read similar postings to get other perspectives. Good luck!

You can go to court and start an eviction. What is the current status of the person you want to evict ?

21 and 19 yr old sons. Both are impossible to live with. Seem to think I need to provide everything for them until they decide otherwise. 21 yr old is unemployed. Has been in bed for 2 years. I am trying to force medical intervention. Have section him into a hospital after a violent episode. He is on meds but not much improvement. Up cooking all night on comuters etc. I have started shutting power off in my house at night (circuit breakers) and taking modem up to my room. He is so mentally unstable I fear for my life not by what he says but how he looks at me. 19 yr old finally has a job at walmart. I had him court ordered into rehab last summer. Is alcoholic. On probation. Pc'd many times. I just want them to go. They have no respect for me or my home. My 19 yr old spit in my face because I was upset at him cooking pizza at 1:00 in the morning smell comes up the stairs into our room. My new husband is ready to leave. We own our home... otherwise I would try to move away. Help!

In these cases, the adult child is considered a TENANT. Eviction would be the same as if it were them living in a rental property you own. You are not required to house/support adult children but you must abide by your states lanlord tenant laws.

You can provide a written eviction notice that would include the corrective actions they would need to take in order to avert eviction. Should htye make those corrections to your satisfaction they would be able to continue living under your roof.

If there is a ploice report on file regarding a violent episode or commission of an act dangerous to others(example: playing with matches), you have the ability to give a 3 day notice of eviction. Otherwise, you are able to give them a written 30 day notice to vacate. With out a court order you do not have the authority to enforce. Should you "pack their belongings and place them outside, they could sue for damages.

Your first course of action would be to contact a legal proffessional who is expeienced in landlord/tenant law. It is likely that should you attempt to evict with out the full authority of the court behind you, your situation will escalate.

I have had these same issue with my own, here in NY. Our stipulation was to become gainfully employed or actively enrolled in College(yes, my wife and I are paying for the courses). I wish you the best of luck. DO NOT HESITATE to call 911 when faced with threats of violence directed at themselves, yourself or others. Involvement of the state and local police was a huge help in getting through the thick skull of our middle adult child.

I appreciate your response. My stipulation has been to be gainfully employed or in school. Unfortunately I paid... both stopped going to classes. I have shelled out $65,000 for college for both and have almost no credit to show. Here it is noon and they are both in bed sleeping. Will be getting up around 2:00 to mess up my kitchen. I am in the process of leaving my job. Will stay home until I can get them out. If I don't do this I know my marriage will end. While we certainly need my income... the things that were going on in my home while I worked were so bad and the stress of trying to get back and get control before my husband came home was too much. I have been suicidal over this. It is a long story but my road has been long and hard and to have my children turn out like this is killing me. I have started back to alanon and see a family therapist... have done every intervention I could think of... I am out of gas.
