Can a person who has used all allotted sick days be docked a day's pay if he takes additional sick time?

In NYS, yes.

Calvin, if the employee has no sick time, then they don't get paid for being out. If you have already advanced wages for the time they missed, then yes the advance is recoverable in the next pay period. Do not confuse comp time with this. That is a whole other problem.
