Can the I.R.S. levy or garnish your Pension??

If your pension payment is automatically deposited in your bank account along with other funds, yes, they can get it. Don't have it deposited, have it mailed to your home address.

Sorry, this is not the correct answer, tried to cancel, but couldn't. I realized you were asking about garnishment not a judgment. This answer only applies to funds being taken from your bank account after a judgment is awarded.

The IRS can place a levy on a federal pension under existing law. For other pensions they would need a court order like any other creditor.

An elderly person received a call from the IRS. This person receives a pension. This person co-signed for a student loan for someone and they have not paid the loan in years. Could the IRS garnish the elderly person's pension who co-signed?
