View Full Version : Violation of probation.what happens next?

My boyfriend is on 3 years probation for possession of a CDS. He has only been on this probation for about 6 months now and has been seeing his P.O. each month and coming up clean on all drug tests. Also, as part of his probation requirements he has been going to NA meetings, got a job, and is currently working on getting his GED. However, he caught two more charges.. both at different dates thought.. one is shoplifting and the other was hindering, but the officer said they will most likely downgrade for him to disorderly person. My boyfriend has not been to court for neither of these new charges yet and every time he sees his P.O. they ask about contact with police and my boyfriend says no, because he is scared he will get sent away. My questions if anyone has any advice are what will happen next? Also, is he in violation for not telling his P.O.?

He is required to report ALL police contacts, so if he didn't, that all by itself, is enough to violate him. The charges might, or might not be enough to violate him, but NOT telling the PO about them will certainly violate him.

Each time he lies to the PO about any police contact or not being arrested for something else is just going to make the PO rack up more violations for him. It is a definite violation to be arrested for a new crime and it is an automatic violation for not telling the PO about the new arrests. He's really skating on thin ice and once the PO runs his name and finds out he's been lying he will be sitting in jail and awaiting his probation violation hearing.
