My Landlord owns rental properties in Kentucky and Tennessee, when I signed my original lease with her I didn't think about what this would mean in my case. My current situation is I lost my job and I am about 10 days late on my rent. I came home one day to find a hand written notice on my kitchen counter stating that if I didn't call her or pay she would come over and lock my doors ( change the locks). I recently looked up the Kentucy laws for eviction since my lease has Kentucky laws on it and its for ky and it does say that the landlord could give a 7 day notice and if the tenant does not pay the lease can be canceled and the tenant would then have to get out, however My apartment is in Tennesee. Tennesee laws are very different and would actually work in my favor. What I want to know is can my landlord enforce my lease which states the ky laws for evicition or Tennesee laws since my apartment is located in TN? What legal options do I have.

Hello Kg.

The laws where the apartment is located are the ones that are valid... That would be TN. Nope, she can't lock you out. I spose there's no law about threatening to, though. If she does, she's guilty of unlawful eviction, and you can sue her bigtime.

Keep reading the law. You'll find that if she follows the law about evicting you, it'll take a few weeks. You can pay your rent anytime up till the time a judgment is rendered.

So, you can ignore her, or you can send her a letter telling her to STAY OUT of your apartment. By not doing so, she's guilty of trespassing, and you won't hesitate to call the cops the next time it happens. Send your letter certified, return receipt requested. I'd also be looking for a new place.
