View Full Version : Roommate Eviction in NJ - No lease

I have a house in NJ in which I have a friend as a roommate. The rent started as $500.month, but she fell behind. I then started asking her for weekly rent of $125 a month, and she has still fallen behind in payments, and is now $1500 past due. She is a friend of mine, but I've been nice, but enough is enough.

Also, she asked me to feed her cat and I noticed that the rug was torn apart from the cat. That was the last straw.

Anyway, I am planning to ask her for the rent, but I want to say something like "You have XX amount of days to pay or get out!". This situation is a little different than most because I have no lease with her, and I own the house. What are the legal ramifications. How should I go about doing this. I was planning to ask her to start paying $225 a week to begin making up for it, but I have a feeling she won't be able to. If she doesn't I really want her OUT by the end of the week.

So how can I go about doing this, and also, can I sue her even though I have no lease?

How long must I give her to get out. If she does not, can I lock the door and not let her in?

If she is a resident there, she must be evicted according to the laws of NJ.

It is illegal to lock her out OR throw her out without the prescribed notice.

Can you changes locks on doors with out consent of Landlord and if the roommate has not been staying in apartment but she is paying her share of rent??

I live with 2 other people and shared rent and utility's.. I left for a couple of months but had an agreement with the land lord
That I'm still going to be living there but not staying allthe time my family member is I'll. She said fine mundane was Paid to landlord directly .
I came back to clean my room to move back in and the locks where changed with put me knowing or the landlord is that illegal fir the roomates to do?? What can I do??
