violated probation with a dirty urine. Serving 10 year term and have done 1 1/2 years of this probation with no problems. The 10 years probation was part of a split sentence. I served 14 of a 20 year prison term and had the 10 years paper to follow. What are the chances of being sent back to prison or will I be reinstated because this is the first time I had any trouble. I feel that having a paid attorney would raise my chances of being reinstated. What do you think will happen and should I retain an attorney or go with P.D.

Hello b:

If the pd will represent you, take them. But, you're not entitled to a lawyer like you were before you were convicted. That doesn't mean they won't give you one... But in Florida, I wouldn't bet on it.

I don't know what will happen... But, if you're OUT waiting for a violation hearing, that's a very good sign. If you were going back, you'd probably be in jail right now.
