My mother and I were title/deed holders of a home. After 11 years, my husband and I wanted to refinance. There was a quitclaim deed signed and notarized to my husband and I. Shortly after, we went with another mortgage company. We are now separated, going to divorce. I do not live at the home. He is currently serving 6 months in Pinellas County jail, in Florida. I want to take over the home. He says he will have his attorney serve an eviction notice to me, and have me arrested for trespassing. I looked at the proper5ty appraiser website today and noticed the ownership of the house was in both mine and my mother's name. What legal rights does he have to threaten me with arrest/eviction. What rights do I have to move into the house?

If your mother quit claimed the deed to you and the husband, her name should be off, did you record the deed you and mother signed. If not, it can still be recorded.

But on either deed you are listed as owner, so no one can evict you off unless the court gave him ownership of the home in divorce court.

So don't look at the appraisers web site, not look at the tax office, go to the recorder of deeds office and see who is officially the owner at the deed office.
