View Full Version : How do you get out of doing guarentor for a rented house

I did guarentor for my sons girlfriend but they have now split up and I want to know if there is any possible way to get of the contract. I would really appreciate any advice that anyone can give me

There really isn't any way out, and this is exactly why the landlord wanted a guarantor. If she sticks you with bills, then you can sue her... Good luck with that.

You can ask to be released, but why would the landlord do that? You are his safety valve if the tenant doesn't pay.

What you definitely should do is send the landlord a letter stating that, when the lease expires, you will not guarantee a renewal. Unless the lease has a auto renewal clause that include you as the guarantor, that should get you out of being a guarantor for the renewal.

But as noted inform the landlord that as of the date of the end of the lease you are to be released at renewal.

And till that time, you hope they pay the rent, hope theydon't leave 1000's of dollars of damages
