My husband and I have outstanding legal fees close to 100,000 owed. We refused to sign a mortgage note for the amount owed which gave him the right to foreclose next year. Can he put a lien on our house anyway and if so, can he foreclose whenever he wants?

He can't put a lien on your house without suing you and winning a judgment. The judgment acts as a lien. But once he gets the judgment he can't foreclose. He has to wait to get paid until you either refinance or sell the house.
