I currently live in ny state. I have a child support order until my son becomes 21 or becomes emancipated. If my son fathers a child is he deemed emancipated automatically, can his father terminate child support because of this?

How old is the child, is the child still in high school or in college

Is the child living at home or where'
Is the "till 21" dependent up on him being full time in college.

Is he going to marry the babies mother

Sorry if I wasn't clear, my son is 19, lives at home with me, not in college, not working yet, and possibly impregnated a girl, whom he will not marry, can my ex terminate child support based on him impregnating this girl, making him emancipated based on him having a child

No. Some states have laws that emancipate the MOTHER of a child. This is to allow the mother to marry or get benefits for herself and the child. But fathering a child will emancipate the father. As long as your sone continue to live at home under your control, his father will have to pay support.

I think you might find some interesting reading here. The child is over 18 and is considered an adult. Yet may or may not be emancipated by law. Very strange.

Did you know that if the 'man' was going to school, even college, the father could not emancipat your son. By the way, he should be working to help you and he would still get his money from papa.
