View Full Version : Do I have legal rights regarding a maintenance agreement for a shady dealer?

Our public sector company had an old junk copier that broke down 3x/week. The lease ran out so the rep offered us a 5 year maintenance agreement, which I signed because I didn't have any choice. We had to outsource thousands of dollars in copy jobs to two other firms due to opening other state offices. We started doing some research on new copiers and our IT Director 'knew a guy' at a company who got us a new copier for less than the maintenance agreement. I called the first rep and told him to come get his machine and he did. I told him he was severely undercut from the quotes he gave me. Now he is threatening me (extorting?) to continue to pay the maintenance agreement for equipmeht we don't have, unless I guarantee him our business in the future or purchase some equipment he is forcing down my throat - he said he would 'waive' that agreement if we purchased it. I now refer to this person now as the Blackmailer. He is strong-arming me into purchasing additional equipment and I'm sick of it. I haven't taken this to my boss yet, I wanted to handle it on my own first. Am I required to pay the agreement for 5 years and what are we paying it on? Thank you.

I think you DID have a choice as the subsequent events proved. Therefore, you signed an agreement and obligated your company. You WILL have to fulfill it.
