View Full Version : How to pettition for temporary custody of my son?

I am 19 years old and I have a 2 year old son and I was wondering how to pettition for temporary custody on till reconsile or a court date. I have my son but am afraid to let him visit his father because he might not bring him back. I have no way of paying for an atturney so I don't know what to do? I really want his dad to be a part of his life but I need to get the pettition fist. How do I do that?

What state do you live in? Has he been legally established as the father through a court-ordered DNA test?

First, if you are the mother you already have custody. For anyone else to have custody, they would have to be listed on the birth certificate or have be declared the legal father.

You also have to understand there are two forms of custody; legal and physical. In legal custody, the custodians have a say in the rearing of the child. In physcial custody, one custodian as primary custody, while the other may have visitation.

So you may need to do NOTHING until the father acts.
