Hi ATE,

I am a dual status person for US tax return. I was a resident at the start of the year 2008. The left the country in the last week of June 2008 to Canada and therefore I am a non-resident for part of the year. In my situation, according to the IRS, I need to file form 1040NR as a "Dual Status Return" and form 1040 as "Dual Status Statement". I earned about 10K when I was a resident in the US and did not earn anything after I left the US. So, my questions are 1) do I need to only fill form 1040 (lines 1 through 73d) and attach 1040NR with '0' s for lines 1 to 70 since I did not earn any money during my non-resident status, or is it the other way around? 2) I was in the state of Oklahoma during 2008, what forms do I need to file with the tax commission? 1040NR is your actual tax return. So you will complete it reporting all you income. You will compute your tax and tax refund or tax you owe.
Form 1040 is statement form. Complete only the required lines, for example your W2 income (during resident period), taxes withheld any other deduction.

For Oklahoma you are part year resident up to June 2008.
