I need help with a disturbing matter, ill start with that 18 months ago I had surgey for prostate cancer and now I am being followed up with blood work every 6 months to test for psa elevation.
Here's my story, Two weeks ago I'm out on my snow removal run when I get a call to go clean a drive way,I do the job and enter the house to get paid.The lady meets me at the door and askes how I'm feeling,I reply fine.She then go's on to say " Well on march 19th your psa levels were 0.6 and that isent good".I stand there in disbeleife at how she no's my test results along with the exact date I went for tests.
She then says that she is looking out for me and says"you dident no my son inlaw was a doctor eh,and my daughter works at a clinique".. then she says the doctor asked if I still smoked and she replys yes.She says a few other things but I just ignore her as I'm in shock at what the hell has just happened.

I come home,tell my wife what just happened and she explodes.. Now I do a little investagating on my own and go to our local hospital and ask the lady who works there how is it possible for some one to access my records,she says they can't unless they are a doctor and are in your circul of care witch he isent.I now talk to the blood teck and she says the same thing,and then with the prfacy agent for the hospital, she confirms this.

My question is what are my legal rights here?. forgot to add I applied for a job with the municapality and was told I wouldent get the job even though I am more that quilafied because of this person telling every one that I am sick with cancer again.I live in a small town and we all no how things get out of hand with rumours, 1st I was OK,then takeing kimo,now I have 6 months to live,lol.. gotta love a small town.I live in norther ontario, what can I do about this other that getting him fired?

I think my next phone call would be to an attorney. In the US there is what is called the HIPPA laws, where your medical info is protected, an attorney will be able to help you handle this. You have suffered the loss of a job, have been the victim of rumors, etc. and should be awarded punitive damages. The doctor and his wife, and the woman are all guilty. The hospital and clinic are responsible for their employees, we sign a confidentiality contract upon hire in the U.S. Good luck!

I have contacted my lawyer we are leaveing the ball in there field.The administrator was suppose to get back to me today but hasent as of yet.Now today is a whole new story, people are saying why the hell did I even bother doing thisno big deal some are saying until I told them(one woman in particular) what if I called Doctor Joe my best friend and asked him to check your last test results for a pap smear,well now the story changed,lol.

Funny how when its some one eleses privacy it doesent matter,when its there's it's a new game.I no after all is said and done ill be the hole for bring this matter up but guess what? I don't f@#$@ care any more.Thank you for your comments mum 45 :).Im hopeing some one from Ontario canada had the same issue and what the out come was, with my luck this will drag on until I'm dead,lol.

What a good way to have put that! LOL about the pap smear question! Best of luck to you, I do realize that people in small and medium size towns think maybe they are "looking out" for a member of the community by saying something to someone else out of concern, but in the long run, it has caused you problems. That's why privacy is a must! Also, a lot of people in hospital jobs have just enough knowledge to be "dangerous" and read way too much into what they see! Then, rumors fly! No wonder my mom goes to Little Rock for the big stuff, and to the local clinic for a cold!!

P.S. Worked in hospital in numerous outpatient areas. Had to sign confidentiality agreement upon hire. This agreement was even before the HIPPA laws came into effect. Just wanted you to know.

Yes mum I realize people in small towns try to look out for each other but that is crosing the line.. I loved using the pap smear test with a couple wemen who said this was no big deal,lol.. you should have seen the shades of red,lol.

Yup yup, would have stopped me in my tracks! Open mouth, insert foot would have been my next thought. Or maybe, speculum!

Morning mun.The hospital admin hasent got back to me with his findings in to his investagation, I will be going to our hospital privacy agent this morning to acesses my file to get a time and date my files were looked at by said doctor, keep u updated.
