View Full Version : What legal rights do we have with our landlord?

OK here's the story,will try to keep it simple-moms ex boyfriends dad owns a duplex,(landlord) we moved in because he gave us permission to.moms xboyfriend is an alcoholic,we don't live with him,xboyfriend got drunk,talked to his dad said some stuff about us living in the duplex,his dad (landlord)got mad yelled at my mom etc... now we have to move out in two days or wer threatened to go to court. We had no notice of him coming over,he said some very mean things to my mom,the upstairs duplex is not even finished yet-unfinished walls,broken pipes,unfinished sink,unfinished lectricity,no heat and there are electric cords sticking out of the wall and a hole in the floor.what legal rights do we have about this situation? Can he even take us to court? We did not do anything wrong but yet he is threatening to take us to court. We paid all the bills on time through my moms xbf but who knows what he did with it,prob spent it on boos. There wer no contracts sighned for anything.

Hello I:

You have the right to be given 30 days notice to vacate. If he takes you to court, tell the judge that. However, beyond that, you need to do the communicating with the LL, not the drunk xbf.

What rights you have are determined by what agreement was made and how long you have been there.

If you agreed to pay rent and/or utilities, and these bills are up to date and you can prove it, then he has to go through a formal eviction process. This means he has to give you a 15-30 day written notice to vacate. The amount of time will depend on where you live.

Only after that, if you still haven't left, can he file for an eviction order. You don't want to let it get that far because if he gets an eviction order it will make it harder to find another place to rent.

I agree with ScottGem & Excon my advice to you also it to look for another place and get out as soon as possible, this situation is only going to get worse.
