I am a personal rep for my mothers estate. She had a woman living with her to help her out during the last few years of her life. The woman lived rent-free and mother paid her a monthly stipend to help out (clean, run some errands, make meals once in a while).
Mother died in December 2008. We (beneficiaries) let this woman live there until February 14, 2009 when we verbally asked (and she agreed, verbally) that she find a new place to live and vacate the condo by March 15, 2009. She did not.
On March 23, 2009, we gave her a written notice that she needed vacate the condo by 4/19/2009 (28 day Tenant at Will notice as required by Wisconsin Law). When we went to the apartment on 4/19, she was watching a movie with a friend. No intent on leaving.
Because this woman has no lease (never has), is not paying rent, utilities, taxes etc and has over 4 months to find a new place to live, the question is: Is this a "legal" matter that has to go through Small Claims Eviction process or can we just move her out?
