A friend of has been accused of sexual assault of a 14yr.old that was a step sister. She made allegations but through medical and flaw statements she has made... her stories are never the same. He was arrested 7 months after the allegations were made. CPS waited two months before they took her to a doctor to be checked out. They did zero rape kit on her and medical reports say no sexual activity noted. My friend has been waiting almost three yrs for this to go to trial. Since, then while she was in a foster home... the foster father is being accused of the something. He was arrested the day she made the allegations, and DNA tests were done... proving the foster father did have sex with her. This girl who is 17 now is getting both her stories mixed up and she is saying now what the foster father did to her , my friend now did it to her.I do not know how my friend can get a fair chance when this girls stories keep changing through out time. My friend has lost his job and never ever touched this girl. The DA refuses to release doctor reports and provide my friends attorney evidence. The DA is basing there entire case on " heresy". Is this usual for the DA to make a case out of nothing but an allegation?

Yes, a lot of cases go to court with little evidence in some of these cases. After that what is your friend doing, what about their attorney, the DA can not refuse to turn over any evidence,
Why is the friends attorney not filing for a speedy trial.

My friend is really getting more and more depressed.
HIS attorney has filed motions to get doctor reports and more medical reports .DA keeps delaying the process... the judge warned the DA but nothing is ever done. My friend just wants this over with because he is tired of all the BS and wants to go on with his life.

I trust you mean hearsay, not heresy. The DA appears to be basing part of the prosecution on he said/she said.

Unfortunately these things drag on forever.

THE DA in this case is mad because the biological father and step mother does not believe the child and supports my friend totally and without a doubt. The DA threaten the father and step mother of allowing this to happen. They tried scare them by telling them that they were going to jail.No charges have ever been brought forward on them.
IF this actually ever goes to trial... and it is proven that he is biological of charges... can he sue the person who made these allegations?
