View Full Version : Filed 1040 Instead of 1040NR

Hello,

I am an F-1 student. I used E-file to file my federal return and found today that it used 1040 instead of 1040NR, which I should have used as I have been in US only for 4 years. I researched that I have to file 1040X and 1040NR(EZ) and 8843 and send it as soon as possible. My return from Federal was 900 odd dollars using 1040. By using 1040NR I found that I should get back 400 odd Dollars.
I had applied for Direct Deposit, and according to the E-file website, the check gets deposited by 2 - 3 weeks. Should I wait for the check to come and then send a check for 500$, or send the 1040X which tabulates to me receiving 400$.

On F1 you are nonresident for 5 years.

If you filed resident return instead of nonresident return, then you must file IRS Form 1040-X with properly done nonresident tax return Form 1040NR or 1040NR-EZ and Form 8843.
If you owe tax, write check to United States Treasury and enclose with the amended return.

Thanks for the reply,

I do not owe any money. In both cases money has to come back to me, with 1040 I get back 900, with 1040NR I get back 400. I had already sent 1040, it has been accepted, but I have not got the refund yet. Should I wait for refund to come or should I file the 1040X with NR before the refund comes to my mail?

You probably have the refund by now, so file the Form 1040X with a properly-prepared Form 1040NR-EZ and Form 8843 attached.

Do this for every year you filed a tax return.
