My ex wife is living in our home under the court order of use and possession; during this time the house was broken into. The insurance company issued a check in both of our names, [that is how the policy is written] to replace HER stolen property. She without my knowledge or permission forged my name on the check. The bank said that they will not do anything, it would be a civil matter. Although I am not due any money from the check, I am very concerned about her disregard for my rights, and the law. Do I have a case? What is the penalty for her actions?

No harm; no foul.
The money was due to her. You admit you had no claim to any of it. So she didn't sign your name fraudulently.

Here's my problem - you posted as the wife; now you've posted as the husband. Which are you?

The other issue I have to ask, as the husband were you refusing to sign, trying to ask for part of the money or not signing.
While she was not suppose to sign, and it was fraud, the other issue is that it was all of her money, so you did not lose anything, So you have no civil claim, since you lost no money
