View Full Version : OPT-H1 Dual Status Taxes and Student loan interest

Hey guys,
Just a quick question regarding my taxes. I have pretty much everything set but something is confusing me and I thought I should double check before I mail in my forms.

I am a Pakistani nation and during the 2008 year, I was on F1 visa and working through my OPT with a firm in Iowa starting Feb 2008. Come Sept, I got my H1 and started working on that.

I received two W2s, one for the time I was on my OPT and one for the duration of the 2008 on which I was on my H1 visa. I filled out my 1040NR and 1040 for the W2s respectively. I needed clarification on the following things:

1. I can still claim standardized deduction on my 1040?
2. Do I enter Student Loan interest on both 1040 and 1040NR or do I do it only on 1 of the forms?
3. Also, Pakistan and USA have a Tax Treaty which provides $5,000 deduction. Can I claim this on my 1040NR?

If you are single, then you will file nonresident tax return and form 8843. You will not get standard deduction. You will get treaty deduction.
