View Full Version : Eviction Judgement for the Wrong Address(Oregon)

Hello I have a question I was hoping someone could help answer, I tried to rent an apartment a couple of weeks ago only to find I have evictions on my record from an apartment I lived at 6 months ago :confused:

Turns out the eviction is in my name but the address is W-108 instead of V-108 where was living. I talked to the manager and they claim I never gave 30-day notice when I moved out which is not true but I have no proof. I'm pretty sure I can dispute the eviction as it is obviously wrong but would I still be stuck with 30 days rent minus the security deposit I never received?

Hello a:

You had an opportunity to contest the charges when they were levied against you. You didn't. I don't think you're going to be able to go back and change anything.

I never had a chance to contest the charges because they posted the summons on the door of a different apartment so I was never notified when it happened. A new apartment management company took over when I was living there which is why I think their records got screwed up.

Hello again, Oli:

Ok, let's say you can get the default judgment overturned. When you go back to court to hear that motion, you'll be served properly with the eviction lawsuit and you'll start that all over again. It seems to me that you'd lose since you're no longer there... But, maybe not...

I just think you'll be delaying the inevitable.
