View Full Version : Conspiracy to Commit Theft (while on probation in NJ)

Good afternoon,
Two days ago a friend and I went to wal-mart in the morning, she went inside, and on her way out, a wal-mart security guard attempted to stop her by grabbing her and stepping in her way. I got out of the car (which was hers), told this man not to touch her, and so he let go. We got into the car, and we drove away. We were pulled over in another township, and told that they had been looking for us for quite some time. They put my friends in cuffs, and proceeded to search the car. Nothing was found, my friend was taken out of handcuffs, and we were told to proceed to the police station in the township where the wal-mart incident had happened, we were not arrested. Upon our arrival, I sat in the 'interview' room with my mother, signed a statement that included a summary of my rights, and an agreement to write a statement. I wrote my statement, as did my friend, in which she admitted to stealing to merchandise and that I had no idea of or anything to do with her situation, and we were both put into a cell momentarily while the officer processed our information into the computer. My friend was charged with Theft and Conspiracy to Commit Theft, and I was charged with Conspiracy to Commit Theft, and we were allowed to walk out of the police station with no bail.

Now here is where the help is needed. I am currently on probation, which ends in July. There was absolutely no stolen merchandise found, and my friend informed the officers that I had nothing to do with it, and that she had gotten rid of the merchandise already on her own. I am curious what this means for me considering I am towards the end of my probation. I'm wondering whether my probation officer will find out, and if I can be punished before a conviction is reached? Is it possible for me to acquire a public defender, and to attempt to fight it, while by the end of this my probation will have ended? Does this conviction mean certain incarceration? Is it possible that my probation officer will not see what has happened and end probation for me before my other case is solved? Please I am not looking for advice on how to live my life better or how to stay out of trouble, I am more than capable of figuring this out on my own. I strictly need legal advice and as much help that can be given will be much appreciated. Thank you and have a wonderful Easter.

Oh yes, I forgot to ask, is there any way I can do SLAP or PTI instead of going to jail in case of a violation of probation? Thanks again.

Are you on felony or misdemeanor probation? For how many years?
When is your court date for the theft?
What makes you think your PO is not going to find this out?

I am on misdemeanor probation for one year, and it ends this July. My court date for the Conspiracy to Commit Theft is April 20th. Nothing makes me believe my PO won't find out about this... actually that is what's worrying me enough to post here in the first place.

It will be worse if your PO "finds out" than if you TELL him/her. You are required to report this.

Only the PO knows if you will be violated (and I assume you will) and only a Judge knows what will happen next.

Probation obviously did not make an impression on you so the Court will look for other means of punishment.
