If you do not put a child's fathers name on the birth certificate, because paternity is up in question. Would he have any rights to the child if a paternity test has not been done?

Not till he asks for a test though the court. But to be honest it is best to clear that issue, get all the possible fathers tested, you don't have to list them on birth certificate, but you get a custody order in court

Also a birth certificate is a legal document. You could be in trobule if you falsify the because. Not putting the father on the because is just a delaying tactic if he decides to assert his rights.

Anyone has rights to the child if they believe through truth or deception that they are the father of that child. The next step would be to have the courts affirm those rights directly. Even if someone else is named the father there may be certain challenges that can come forth.
