View Full Version : Tenant Refuses to Pay Rent

My tenant moved in three months ago and has been late on every payment. Now, she is saying that she is not going to pay rent this month because my husband that I am trying to get a divorce from called her and said that she doesn't have to pay rent.

I am the sole owner of the property, the rental agreement clearly stated that I am the landlord. Under what expection can she the tenant be justified in not paying rent.

I have already sent notification for payment or eviction but I am really confused as to what she is thinking. Please help...

It doesn't matter what she is thinking. All that matters is that she has to follow the terms of the rental agreement. If she doesn't pay the rent within the notice period then you should file a lawsuit for eviction. Let her try to tell a judge what she's thinking.

Obviously your husband is trying to make trouble and she's jumping on that to get out of paying rent. If you have already sent her a pay or quit notice, then wait that out. File for an eviction order as soon as it expires.

As Lisa said it doesn't matter what she is thinking only what she actually does (or doesn't do).
