Hi, my name is Garry. I hope this site can help with a problem that I have.

I have just been served with a summons from an attorney's office. Brumbaudh & Quandahl PC from Omaha, Nebr.

There is no court date. Just a summons to respond in 30 days. This is for a credit card debt of appx. $6800+interest.

Upon retirement, I was not able to continue to make this payment.

My question, how do I respond to this summons? Can I ask for confirmation of debt? I am not able to pay this debt.

Would appreciate any answers pertaining to this matter

Hello Gary:

You have two choices, and neither of them are good. You're not going to win your lawsuit.. So, delaying it will only cost you more money. Those lawyers charge by the hour, and you're going to be billed for their extra time.

So, you have to scrape some cash together, and do some negotiating... With CASH, you can probably get the debt WAYYYY down.

The other choice, if your retirement is SS, and you have NO other assets, is to tell them to pound sand, as you're judgment proof and they'll never get a nickel.
