I moved in my house in November 2008, my landlord has promise to come back and fix the back screen door and a piece across the bottom of the door. There is no gutters on the house which he said he was going to put up, he has not yet done it. When it rains there is standing water in the yard. He has said the brought another house and is waiting to get extra money so he can come back and put the gutters up. This month I am late paying the rent and he said there will be 5% late charge. My question is (is 5% late fee to high on a rent of 775.00 or is that too high, consider the fact that I have never been late and none of the stuff is done on the house that he promise to do)? That is a 40.00 late fee, which I have never paid that much on a late fee. Please help me out.

He can charge whatever late fees that are stated in the lease.
Tell him that it is his responsibility to make the repairs as timely just as he expects to be paid in time. That if he is not going to get the repairs done you are calling the board of health and the municipal or city inspector.

If the lease doesn't specify a late fee, then 5% is a reasonable amount.

As to the repairs, document your requests for the repairs and give the landlord a deadline to get them done. If they are not done, tell him you will have the work done and deduct the amount from the rent.

Look at your lease. If it says 5% late fee, then he can charge you that. Also for the repair thing. You need to tell your landlord that you have been asking him for a while to do the repairs needed and that if he doesn't repair them sson then you will be moving. But in pa you must give the landlord a written complaint about repairs. I would also put a time frame in which is fair to complete these repairs. If he still doesn't complete the repairs I would move.
