View Full Version : I am being sued by Credit Card co.

After browsing and seeing similar questions... I have to ask for myself. About 3 or 4 years ago I was advised by consumer credit counseling services to stop paying my credit cards if I couldn't afford them. The lady basically said you need to pay your house and electric and buy food first... so I stopped paying. I just got into a depression knowing that I had unpaid bills out there. I tried mediating with some of the companies but couldn't afford what they asked for. Now I am being sued by Chase. I don't know what to do. I am very worried about this. I am in Texas, can they garnish my wages or bank accounts? This worries me because I work in a financial institution ( embarrassing I know) to have gotten myself into this. I had to take a huge cut in pay when I had my son by switching jobs. Any advice?

First of all, whoever gave you that advice should not be in credit counseling. There are tons of other ways to resolve your financial problems; ignoring them is terrible advice.

I've read on other threads that TX is one of the states that doesn't allow a creditor to go after personal assets for unsecured debt. I would try making arrangements with Chase outside of court if you can; while they may not be able to come after you, they can put the judgment on your credit report.
