View Full Version : VA Eviction Issue, No Formal Lease

We have a small home in Virginia that we allowed some "friends" to stay, provided they pay $125/mo to help us pay the taxes on the property. There is no formal rental agreement, just a verbal one. They have trashed the place, never pay their rent and we have helped them until we have nothing left to give. The house is not perfect, but they knew when they moved in - we had it checked by the county and it was approved to be lived in. We want them gone and as quickly as possible and everything I can find deals with the Tenant Act for eviction and I do not believe we are covered under that act. Anyone have any ideas? They have 2 small children that I love to death, and that is the only reason I have allowed things to get out of hand. They have placed mounds of trash in the back yard, done things to house without asking, trashed the appliances, abandoned their animals for days at a time, the list goes on. Thanks in advance!

Even though there is no written lease you're still going to have to follow the laws for a formal eviction. First you must give them a written notice that their tenancy is terminated and they must move out within 30 days. If they haven't moved out by then you have to file a lawsuit for eviction.
