So my boyfriend just got arrested for the second time in the last six months for a probation violation(drinking), the last time he got off with house arrest for two weeks and his fines. What I am wondering is the chances of him getting house arrest again? I am eight months pregnant and am without family and really don't want him to spend time in jail, but I am wondering if that is automaticaly what will happen. Is there anyway I can appeal to his probation officer will it help, I going insane someone please help me!

Hello k:
Certainly, at his hearing, you can tell the judge anything you want... But, it probably won't make a difference...
Your boyfriend needs to stop drinking... THAT will make a difference.

You didn't indicate if his probation was felony or misdemeanor. The fact that he's already violated once and was under house arrest versus jail time, I seriously doubt if the Judge will look too kindly upon his messing up again. I think you're going to have to face it - he's going to go to jail for a spell. You and he will find out at his VOP hearing. And yes, the Judge does not care if you are pregnant and on your way to the hospital to deliver, etc. That has nothing to do with the fact that he messed up again. Sorry, but the Judge probably won't take that into consideration nor will he let your boyfriend out of jail to be there. Only on rare occasions do inmates get to go to the hospital to visit someone. You are not his wife, you are his girlfriend hence you are not his relative.
