View Full Version : Social security and medicare taxes not deducted on H1B

I have been on F1 OPT from Jan 2008 to Oct 2008 and then changed my status to H1B. When I checked my W2 from my employer, I found that they have forgotten to deduct Social Security and Medicare Taxes from my paycheck. So those fields on my W2 show up as 0.

While going through the forum and looking at answers from several tax experts, I understand it is the employers responsibility to collect these taxes and I should not be held liable for their mistake. Is that true?

My question is that should I file the tax return with the current W2 or talk to my employer and get a new one?

Also do I have to pay all these taxes now?

Note: I am a full time employee and not a contractor with this company.

File tax return with current W2. Make sure that employer is deducting FICA taxes for 2009.
