View Full Version : Lived in NJ Worked in NY for 3 months later moved to CA. Which state taxes need to fi

Hi,

I lived in NJ Worked in NY for 3 months(Jan, Feb, March) later moved to CA.

Here are my questions related to tax filing :

1) Do I need to file NJ or NY tax returns or Both? ( Here I know that I need to file CA state tax returns as I am current residant of CA)

2) My Wife don't have ITIN yet. What should I write for spouse ITIN if I want to extend my NY tax return filing date(if I need to file NY tax)?

I forgot to mention, I have an income of $12.95 (interest for my apartment security deposit for 3 months Jan, Feb and March) in NJ state

You will file NY return as nonresident and report 3 months income.
You will file NJ return as part year resident and report 3 months income. Then claim credit for taxes paid to NY.
You will file CA return and report income earned while in CA.

Do I need to apply for extension of NJ , NY and CA tax returns filing too?

All three states accept the federal extension as applying to their state tax return.

I recently moved here from New Jersey. I retired from my job end of June 2012 and now receive a state pension. I turned 66 in May 2012 and started to receive Social Security at that time. I also separated from my husband - no legal papers - and plan to file jointly with him in New Jersey (he stayed there). My question is do I have to file state income taxes for my time spent in South Carolina? I moved here in the beginning of October, bought a house, have made no money working but do received social security plus a NJ pension.

Yes, you Do need to file a South Carolina tax return as a part-year resident. You also have to file a New Jersey return as a part-year resident.

You will pay taxes only on income received while a resident of each respective state, but you will be taxed at the rate for ALL of your income for the year.

You have the option of filing jointly for both state returns as well, which is probably best for you.
