Hi,
My husband willing be filing for Tax jointly. I am currently on H4 and he's on H1B.
However we know that on applying for federal tax we will get ITIN no. But that would take 4-6 weeks to come and then we can file for state tax.

I know it will cause delay but will that cause problem applying late for state tax while waiting for ITIN no or can we file for state tax without ITIN no and then send them ITIN no.

Please help..

If you are filing joint return with W7 (ITIN application), then apply for extension for state return. File after you get ITIN. Pay any tax due before April 15, 2009.
