Okay, let's say that you have given a 30 day written notice for your acult child who has not yet graduated from high school to move out and the 30 days have passed and you have filed the eviction papers with the court. Is there any chance that he will be able to fight the eviction especially if he is not going to school on a regular basis even though he has not yet graduated, he does not have a job and is not paying any rent and is not following the rules of the house and is being disrespectful, and causing stress and problems with other members of the household, including to underage siblings. What are his chances of being able to fight the eviction?

He can fight anything he wants... it doesn't mean he'll win. Odds are he won't even bother showing up and you'll win. Even if he does show up, you'll still probably win.

If he is still enrolled in high school, ( not expelled) he may ask for aditional time and it is possible he can get it. It is just a case by case situation, no for sure answer, depends on how good his defense is, and how liberal a judge is
