View Full Version : Lack of personal jurisdiction

I have to write a motion in opposition of the defendant's motion to dismiss a civil case for lack of personal jurisdiction. Are there any websites that you know of that give examples or templates for writing motions? I filed in the location where I did due to time constraints, and the fact that I was employed and living in the state where I filed at the time of filing. I was under the impression that if I filed in federal court that would be fine regardless of the state. I do not know if requesting that the case be transferred to the appropriate jurisdiction will work. Thanks in advance.

Thank you ArtLady. Unfortunately, when I viewed the templates at the link there was not one that fit my particular situation. Was I just overlooking the one that you were talking about? Thank you for the assistance.

Normally you will have to merely refile in the proper court ( not transfer the original motion)
Also if you were trying to fall within a time frame, and the defense can prove you filed in the incorrect court knowing it was not the correct court, they may also have issues with that.
