View Full Version : Regarding Federal tax refund clarification for L1B visa holder

Dear Sir

I worked in US for six months in L1B visa.(Year 2008)
Now I am working in India.(Year 2009)
I have to file my Federal tax refund & State tax refund for the year 2008.

I am marred & have my SSN.
During my work period in US my wife was in India.
My wife don't have SSN.

If I entered my filing status as "Married filing separately".
I have to enter my spouse SSN.

In the following options below what is my filing status (1040 Non resident Aliens)?

1.Single
2.Married filing separately
3.Married filing jointly
4.Head of house hold
5.Widower

What should I enter for deduction type either Standard deduction or Itemized deduction?

Number of days in the U.S. in 2006, 2007 and 2008?
You may be nonresident or dual status.

Thanks for the reply.
In the Year 2007 - 154 days
& Year 2008 - 25 days.

You said 6 months in 2008. You also said 154 days in 2007 and 25 days in 2008.
When did you enter the U.S. and leave the U.S. Did you file your 2008 tax return?

If you have spent on 25 days in the calender year 2008, you will file nonresident tax return. Your status is Married Nonresident Alien.
