Hello,

I'm an international student since 2005, BUT by mistake (being unaware of the correct forms), I filled 1040EZ for 2005 and 2006 and 1040 for 2007 using online tax websites. Now this year, as I got info. About correct forms that I needed to fill-in 1040NR-EZ for previous 3 years along with for 2008. As I'm from india, so std. deduction and tax exemption is same as it applies to residents, but I got additional amount for EIC (Earned Income Credit) for 2006 return (in 2007) and stimulus payment check for 2007 return (in 2008).

Now, how should I proceed with filing my 1040X for previous 3 years, do I have to attach my previous online returns (1040EZ and 1040) with the amended returns and 1040NR-EZ and should I fill 8843 only once this time (2008 version)?

Should I use 2005, 2006 and 2007 versions for 1040NR-EZ and 1040X forms?

Should I attach a check (addressed to..? ) for the extra amount I received from IRS for 2006 and 2007 along with 2008 return (total amount I owe to IRS)?

As I was unaware of the correct forms, so should I request IRS NOT to impose any penalty and interest on me as I'm still a student on F-1 and already struggling to manage my finances. Please assist BEST solution in this scenario.

Thanks in advance.

You will file Form 1040X, 1040NR or 1040NR-EZ and 8843. Write check to United States Treasury.
If tax is due enclose a letter Request For Waiver of Penalty. Explain why this happened.
