I am on a J2 visa and started working on April08. My husband is on a scholarship and we can not file jointly. What form should I use?
This tax stuff is so confusing, I need a guide for dummies :(

Both will file nonresident tax return with Form 8843.
On J1 (intern) you are exempt from residency for 2-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843.
J1 income is not subject to FICA taxes (J2 income is subject to FICA taxes) but you must pay federal and state income taxes.

Thanks much for this info.
I used a tax software and end up with 1040A, is that a problem :S ?

Also, the software asked me for "Estimated Tax Payments for 2008" and I thought it was the money the state took out off my paycheck and entered that data but then I saw another line with the state deduction (in addition to what I entered).. what does the "Estimated Tax Payments for 2008" mean?

Form 1040A is resident tax return.

If you did not make any payments to IRS, then you put 0 here.

Payments other than the Salary deductions (State Taxes) right?
