My father left us 3 Properties . The Executor (my Stepmom) immediately put two of the properties on the market and they both sold right away.

Against the advice of her attorneys, the executor (stepmom) planned to keep the third property for herself so she didn't put it on the market. Now, just as they predicted she cannot afford to keep the house and is struggling to keep it out of foreclosure. Now she puts the house on the market but the market value is cut in half.

The estate has been in probate for two years.


Executor (stepmom) wants us to distribute house to her at zero equity based on BPO.

That's bull, we have lost Money due to her inability to handle the estate correctly.What should we do.

Did the Probate Judge approve of the disposal of the first 2 properties? Has the disposal of the 3rd property been approved by the Judge yet?

One property came to us from the courts "request for special notice". The second one came to us from the courts as "Inventory and appraisal" The third is just a letter from her attorney asking us to sign this over

Your and your stepmother obviously are clashing over your father's possessions and intentions. I think you should retain an Attorney and run all of your concerns past him/her. If, as you say, the estate is losing money due to her action (or inaction), then you need to remove her as Executrix and replace her with someone responsible.

If this is just a matter of family dynamics (stepmother vs children) the Attorney can help with that.
