Hi,

I am planning to get a refund for erroneous withholding of medicare and social security taxes. I was reading about tax form 843 online and somewhere I found that in addition I also need to file tax form 8316. Is this correct? Or is this outdated news?

You will file Form 843. It is filed separately. Read about filing Form 843: Your U.S. Tax Return: Social Security and Medicare (FICA) Taxes for Non-resident Exempt Individual (http://taxipay.blogspot.com/2008/03/non-resident-exempt-individual-social.html)
